1. Introduction

Welcome to The Super Coach!
These Terms of Service (“Terms”) form a binding agreement between you (“you,” “your,” or “Client”) and The Super LLC, a Washington limited liability company doing business as The Super Coach (“The Super Coach,” “TSC,” “we,” “us,” or “our”).
By checking the box at checkout confirming that you have read and agree to these Terms and our Privacy Policy at www.TheSuper.Coach/Privacy-Policy, you enter into this agreement. If you do not agree, do not complete your purchase or use our Services.
IMPORTANT NOTICE REGARDING ARBITRATION: THIS AGREEMENT CONTAINS A MANDATORY BINDING ARBITRATION PROVISION AND A CLASS ACTION WAIVER IN SECTION 13 (DISPUTE RESOLUTION). BY AGREEING TO THESE TERMS, YOU AGREE THAT DISPUTES BETWEEN YOU AND TSC WILL BE RESOLVED THROUGH INDIVIDUAL ARBITRATION, AND YOU WAIVE YOUR RIGHT TO PARTICIPATE IN CLASS ACTIONS, CLASS ARBITRATIONS, OR REPRESENTATIVE PROCEEDINGS. YOU HAVE A 30-DAY RIGHT TO OPT OUT OF ARBITRATION AS DESCRIBED IN SECTION 13.
2. Changes to Terms or Services
2.1 Updates to These Terms. We may revise these Terms from time to time. When we do, we will update the “Last Updated” date at the top of this page and notify you by email or by posting a notice on our website. Your continued use of the Services after any changes take effect means you accept the revised Terms. If you do not agree with the updated Terms, you should stop using the Services.
2.2 Changes to Services. We are always working to improve what we offer. We reserve the right to modify, update, suspend, or discontinue any aspect of the Services at any time, at our discretion. This includes changes to program content, delivery methods, coaching formats, platform features, and scheduling. We will make reasonable efforts to notify you of material changes that affect your active plan, but we are not obligated to maintain any particular feature or format.
3. Eligibility and Account Registration
3.1 Eligibility. To use our Services, you must be at least 18 years old and legally capable of entering into a binding contract. By enrolling, you represent and warrant that you meet these requirements.
3.2 Account Registration. You will need to create an account to access our Services. When you register, you agree to:
- Provide accurate, current, and complete information during registration;
- Keep your account information up to date;
- Maintain the confidentiality of your login credentials and not share them with any other person;
- Accept responsibility for all activity that occurs under your account.
3.3 Account Security. You are solely responsible for safeguarding your account credentials. If you become aware of any unauthorized access to or use of your account, you must notify us immediately at [email protected]. We are not liable for any loss or damage resulting from unauthorized use of your account that occurs before you notify us.
4. Description of Services
4.1 We offer professional career coaching services designed to help you find a job. Our services are organized into plan tiers, each with a different combination of features. The specific plans, pricing, and features available at the time of your enrollment are described at www.TheSuper.Coach. Your enrollment confirmation will identify the plan you selected and the fees you agreed to pay.
4.2 Lifetime-access components (The Super Community and The Super Program) remain available to you indefinitely, subject to these Terms and continuity of this business. Time-limited components, including group coaching, 1:1 sessions, and job application support, are available for a tenure of the committed number of days at the time of sale from your enrollment date.
4.3 Services are delivered through our website, community platform, video calls, messaging applications, email, and other digital channels. We may update program content, methods, and delivery formats at any time.
4.4 We do not guarantee any specific job title, employer, salary level, or timeline for results. Outcomes depend on your individual effort, market conditions, and other factors outside our control. 5. Client Commitments and Community Conduct
5.1 The ABC Framework. To get the most out of your coaching experience, we encourage you to embrace the following commitments:
- A: Act and Be Decisive. Take consistent, timely action on your job search. Complete assigned tasks, participate in The Super Community, ask questions when you face a problem with the process, and keep your coach informed of updates and progress.
- B: Be Coachable. Stay open to feedback, ask questions, and implement the strategies your coach recommends.
- C: Clear Priorities. Treat your job search as a top priority. Attend all scheduled sessions and check-ins, and dedicate the time needed to move forward.
These commitments are expectations, not conditions of service. However, clients who follow the ABC framework tend to see stronger results.
5.2 Technical Preparation. You are responsible for your own technical readiness, including hard skills, tools, and software required for your target roles. Our coaching focuses on job search strategy, not technical skill development.
5.3 Community Conduct. When participating in The Super Community or any group setting, you agree to be professional, respectful, and supportive of other members. The following is prohibited:
- Harassment, bullying, discrimination, or abusive language
- Spam, solicitation, or self-promotion unrelated to the community’s purpose
- Sharing content that is offensive, misleading, or inappropriate
5.4 Removal of Access. We reserve the right to suspend or permanently remove your access to The Super Community and group coaching sessions if you engage in conduct that violates this Section 5. We will make reasonable efforts to notify you before taking such action, but immediate removal may occur where we determine it is necessary to protect other members.
6. Scheduling, Rescheduling and No-Shows
6.1 Advance Scheduling. All coaching sessions, including 1:1 and group sessions, are scheduled in advance through the booking method we provide. We will communicate available times, and you are responsible for selecting and confirming your sessions within your program period.
6.2 Rescheduling. If you need to reschedule a session, you must provide at least 24 hours’ notice before the scheduled start time. We will make reasonable efforts to accommodate rescheduling requests, but we cannot guarantee availability of alternative times.
6.3 No-Shows and Late Cancellations. Any session cancelled with less than 24 hours’ notice, or where you fail to attend at the scheduled time, will count as a completed session and be deducted from the allotment. No makeup session will be provided for a no-show or late cancellation unless we agree otherwise at our sole discretion.
6.4 Unused Sessions. Unused coaching sessions (1:1 or group) do not roll over or extend beyond your program period. Any session remaining at the end of the program period will expire automatically unless we agree to an extension in writing.
7. Payment and Fees
7.1 Fees. The fees for your selected plan are as listed on our website at the time of your enrollment. By completing your purchase, you agree to pay the applicable fees in full according to the payment option you select.
7.2 Payment Processing. All payments are processed through secure third-party payment processors. We do not store your full payment card information. You are responsible for ensuring your payment details are accurate and current.
7.3 Installment Plans. If you select an installment payment option, all installments are due and payable regardless of whether you continue using the Services. Selecting an installment plan does not create a month-to-month subscription; it is a payment arrangement for the full program fee.
7.4 Late Payments. If any payment is not received within fifteen (15) days of its due date, we may charge interest on the outstanding balance at the rate of 1.5% per month, or the maximum rate permitted by Washington law, whichever is lower. Interest accrues from the original due date until the balance is paid in full.
7.5 Suspension for Non-Payment. We may suspend or restrict your access to the Services, including coaching sessions and community access, until all overdue amounts are paid.
7.6 Pricing Changes. We reserve the right to change our pricing and payment options at any time. Any such changes will not affect enrollments already completed at the time of the change.
8. Refund Policy
8.1 Plans with ‘Money-Back Guarantee’. If you enroll in a plan with the Money back guarantee option, you may request a full refund within the defined days from your enrollment date. To request a refund, email [email protected] within the refund window. Refunds will be processed using your original payment method within a reasonable timeframe. All other sales are final. No refunds will be issued for other plans under any circumstances.
8.2 After the Refund Window. For plans with the refund option, all payments become non-refundable once the refund window has closed.
8.3 Effect of Refund on Access. If we issue a refund, your access to all Services will be revoked, including access to The Super Community, The Super Program, coaching sessions, and all related materials.
8.4 Installment Plans. If you are on an installment plan and receive a refund within the refund window, any remaining scheduled installments will be cancelled. If you cancel your participation after the refund window has closed, you remain responsible for all remaining installment payments as described in Section 7, and no refund will be issued for amounts already paid.
9. Intellectual Property and Feedback
9.1 Ownership. All course content, program materials, frameworks, templates, worksheets, recordings, resources, and other materials provided through the Services (collectively, “TSC Materials”) are and remain the exclusive property of The Super LLC dba The Super Coach. TSC Materials are protected by copyright, trademark, and other intellectual property laws.
9.2 Limited License. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the TSC Materials solely for your own career development purposes. This license does not transfer any ownership rights to you.
9.3 Restrictions. You may not, directly or indirectly:
- Copy, reproduce, distribute, publish, or display any TSC Materials;
- Sell, resell, license, sublicense, or otherwise commercialize any TSC Materials;
- Share your account login credentials with any other person; or
- Create derivative works based on any TSC Materials.
Violation of these restrictions may result in immediate termination of your access and may subject you to legal liability.
9.4 Feedback. If you provide us with suggestions, ideas, improvements, or other feedback regarding the Services (“Feedback”), you grant TSC a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate that Feedback for any purpose without any compensation or obligation to you.
10. Testimonials, Confidentiality, and Privacy
10.1 Testimonials and Success Stories. We may ask you for permission to use your testimonials, success stories, or quotes in our marketing and promotional materials. Any such use requires your consent, which may be obtained at the time of enrollment, during or after the program, or through a separate written or electronic request. You may withdraw your consent for future use at any time by emailing [email protected].
10.2 Confidentiality. We treat information you share during coaching sessions as confidential, subject to our legal obligations. You agree not to share proprietary program content, strategies, or materials with anyone who is not a participant in the program. You also agree to keep confidential any personal information or stories shared by other community members within The Super Community.
10.3 Community Guidelines. All interactions within The Super Community and group coaching sessions should be respectful, professional, and supportive. Harassment, discrimination, spam, and solicitation are prohibited.
10.4 Privacy. Your privacy matters to us. Our Privacy Policy at www.TheSuper.Coach/Privacy-Policy explains how we collect, use, and protect your information. By using our Services, you agree to our Privacy Policy.
11. Termination
11.1 Termination by You. You may cancel your enrollment at any time by emailing [email protected]. Cancellation does not entitle you to any refund outside of the Refund Policy in Section 8. If you cancel (rather than being terminated by us), you will retain access to lifetime-access components (The Super Community and The Super Program) unless we terminate your access under Section 11.2.
11.2 Termination by TSC. We may terminate or suspend your access to the Services if you breach any provision of these Terms or fail to make a required payment. Upon termination by us for breach or non-payment:
- Any unused coaching sessions are forfeited, unless we decide otherwise at our sole discretion.
- Your access to The Super Community ends immediately.
- No refund is due.
- We may remove you from all communication channels.
11.3 Effect of Termination. Upon termination for any reason, the following sections survive and remain in full force: Section 9 (Intellectual Property and Feedback), Section 10 (Testimonials, Confidentiality, and Privacy), Section 12 (Disclaimers, Limitation of Liability, and Indemnification), Section 13 (Dispute Resolution), Section 14 (Governing Law and Jurisdiction), and Section 15 (General Terms and Contact Information).
12. Disclaimers, Limitation of Liability, and Indemnification
12.1 Disclaimer of Warranties. THE SERVICES, INCLUDING ALL PROGRAM CONTENT, COACHING, COMMUNITY ACCESS, AND RELATED MATERIALS, ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TSC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TSC DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. TSC DOES NOT GUARANTEE JOB PLACEMENT, INTERVIEWS, SALARY INCREASES, OR ANY SPECIFIC CAREER OUTCOMES. TSC IS NOT AN EMPLOYER, STAFFING AGENCY, OR RECRUITER. TSC DOES NOT PROVIDE LEGAL, MEDICAL, OR FINANCIAL ADVICE.
12.2 Limitation of Liability. TO THE FULLEST EXTENT PERMITTED BY LAW, TSC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL. TSC’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO TSC IN THE SIX (6) MONTHS PRECEDING THE CLAIM. Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you.
12.3 Indemnification. You agree to indemnify and hold harmless The Super LLC, its owners, officers, employees, coaches, contractors, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or related to: (i) your use of the Services; (ii) your violation of these Terms; (iii) your conduct in the community; or (iv) any misrepresentation by you.
13.Dispute Resolution
13.1 Informal Resolution. Before initiating any formal proceeding, you agree to contact us at [email protected] and attempt to resolve the dispute informally for at least thirty (30) days.
13.2 Mandatory Binding Arbitration. If informal resolution fails, you and TSC agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved through binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. Arbitration hearings will take place in the county where you reside.
13.3 Small Claims Exception. Either party may bring an individual action in small claims court if the claim falls within that court’s jurisdiction.
13.4 Arbitration Fees. For disputes involving claims under $10,000, TSC will pay all AAA filing, administration, and arbitrator fees.
13.5 Opt-Out Right. You may opt out of this arbitration provision by sending written notice to [email protected] within thirty (30) days of accepting these Terms. If you opt out, the Governing Law and Jurisdiction provisions in Section 14 will apply.
13.6 CLASS ACTION WAIVER. YOU AND TSC AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON’S CLAIMS AND MAY NOT PRESIDE OVER ANY FORM OF CLASS OR REPRESENTATIVE PROCEEDING.
13.7 Severability of Class Action Waiver. If the class action waiver in Section 13.6 is found to be unenforceable, then the entirety of this Dispute Resolution section will be void and disputes will be resolved under Section 14.
13.8 Changes to This Section. If TSC makes any material change to this Dispute Resolution section after your enrollment, you may reject the change by sending written notice to [email protected] within thirty (30) days of the change. If you reject the change, the most recent version of this section that you previously accepted will continue to apply.
14. Governing Law and Jurisdiction
14.1 Governing Law. These Terms and any dispute arising out of or related to them or the Services are governed by the laws of the State of Washington, without regard to conflict of laws principles.
14.2 Federal Arbitration Act. Notwithstanding Section 14.1, the Federal Arbitration Act (9 U.S.C. §§ 1-16) governs the interpretation and enforcement of the arbitration provisions in Section 13 of these Terms.
14.3 Exclusive Jurisdiction. For any dispute, claim, or proceeding that is not subject to arbitration under Section 13 (including actions to enforce an arbitration award), you and we consent to the exclusive personal jurisdiction and venue of the state and federal courts located in King County, Washington. You waive any objection to jurisdiction or venue in those courts, including any objection based on inconvenient forum.
15. General Terms
15.1 Entire Agreement. These Terms, together with our Privacy Policy and any order or enrollment confirmation provided at checkout, constitute the entire agreement between you and us regarding the Services. They supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written.
15.2 Severability. If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible, and the remaining provisions will continue in full force and effect.
15.3 Assignment. You may not assign or transfer these Terms, or any rights or obligations under them, without our prior written consent. We may assign these Terms freely, including in connection with a merger, acquisition, reorganization, or sale of assets, without restriction or notice to you.
15.4 No Waiver. Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision. Any waiver must be in writing and signed by us to be effective.
15.5 Notices. We may send notices to you via the email address associated with your account or by posting updates on our website. You are responsible for keeping your email address current. Notices to us should be sent to [email protected].
15.6 Force Majeure. We will not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including natural disasters, pandemics, internet or power outages, government actions, or labor disputes.
